L'AGCOM ha deliberato di bloccare le numerazioni con una logica di silenzio-dissenso.&lt;br /&gt;&lt;br /&gt;Tutto seguendo il solito copione a cui si è assistito per tutte le altre numerazioni a valore aggiunto: prima i grandi Operatori ne abusano, drenando centinaia di milioni di euro dalle tasche degli italiani (1200 milioni solo nel 2006!!), impedendo ad altri operatori concorrenti più piccoli di far loro concorrenza (in totale dispregio della legge) e poi quando la numerazione diventa disponibile per i piccoli operatori, ormai è inutilizzabile, un po' perchè il grande pubblico la teme come fonte di truffa, un po' perchè la numerazione viene bloccata.&lt;br /&gt;&lt;br /&gt;Ma intanto gli Operatori stanno facendo cassa da un'altra parte, e le sanzioni che ricevono sono minime, pari a meno dello 0,1% di quanto fatturato.&lt;br /&gt;&lt;br /&gt;E la magistratura dov'è?&lt;div class="blogger-post-footer"&gt;&lt;img width='1' height='1' type='text'>Fine del monopolio illegale dei servizi Mobile VAS?</title><content type='html'>&lt;p class="MsoNormal"&gt;   &lt;span style="font-size:130%;"&gt;&lt;b style=""&gt;&lt;span style="line-height: 115%;"&gt;L’Autorità interviene con una delibera: numerazioni 4XXXX interoperabili e di pubblico dominio.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt; &lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;   L'Autorità per le Garanzie nelle Comunicazioni (AGCOM) il 6/7/2007 ha pubblicato sul proprio sito internet la delibera n. &lt;a href="http://www.agcom.it/provv/d_44_07_CIR/d_44_07_CIR_all_b.pdf"&gt;44/07/CIR&lt;/a&gt;.&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;   In tale delibera l'AGCOM &lt;span style="font-weight: bold;"&gt;avvia una consultazione pubblica&lt;/span&gt; ed &lt;span style="font-weight: bold;"&gt;esprime le proprie valutazioni ed orientamenti&lt;/span&gt; in merito alla revisione del piano di numerazione attualmente regolato dalla delibera n. 9/2003/CIR.&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;In tale delibera si legge: &lt;/span&gt;&lt;/p&gt;  &lt;blockquote&gt;&lt;/blockquote&gt;&lt;blockquote&gt;&lt;/blockquote&gt;&lt;blockquote&gt;"L'impiego della numerazione in decade 4 vede attualmente, da parte degli operatori dotati di rete, l’offerta di una ampia varieta' di servizi che certamente non possono essere classificati tutti come “interni di rete”, alcuni dei quali, invece, sono palesemente ascrivibili alla categoria dei servizi a sovrapprezzo.&lt;br /&gt;&lt;/blockquote&gt; &lt;blockquote&gt;&lt;p&gt;Si ritiene che tale situazione debba essere seriamente considerata, approntando in sede di revisione del Piano le disposizioni necessarie a sopperire ad eventuali precedenti carenze normative ed a &lt;span style="font-weight: bold;"&gt;contrastare efficacemente usi non corretti della numerazione&lt;/span&gt;." &lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;Traducendo:&lt;/p&gt;  &lt;ul&gt;&lt;li&gt;L'AGCOM nel 2003 aveva emesso una regola che diceva che i numeri in decade 4 erano solo per i servizi interni di rete e che non necessitavano di interoperabilità fra le varie reti.&lt;br /&gt;&lt;/li&gt;&lt;li&gt;L'AGCOM deve vigilare e assicurare il rispetto delle norme, e ha il potere e il dovere di comminare sanzioni a chi non le rispetta.&lt;/li&gt;&lt;li&gt;L'AGCOM in una delibera ufficiale, 4 anni dopo la propria normativa del 2003, prende atto che tali norme sono &lt;span style="font-weight: bold;"&gt;"ampiamente e variamente" violate&lt;/span&gt;&lt;/li&gt;&lt;li&gt;Nonostante questo, l'AGCOM non ha comminato alcuna sanzione, e ora decide di &lt;span style="font-weight: bold;"&gt;cambiare le norme&lt;/span&gt; per... "contrastare efficacemente usi non corretti della numerazione"!!!&lt;/li&gt;&lt;/ul&gt;&lt;p class="MsoNormal"&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;Questo modo di procedere ci sembra assai pericoloso per uno Stato di Diritto: sembra infatti creare una nuova prassi per suggerire modifiche legislative, e cioè semplicemente non rispettare le leggi esistenti... se si ha un volume d'affari abbastanza elevato.&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;Ciò premesso, approviamo buona parte degli orientamenti espressi dall'AGCOM. &lt;span style="font-weight: bold;"&gt;Il più grave rischio a cui ci si espone nel modificare la normativa esistente è però quello di lasciare inavvertitamente dei "buchi", delle "zone grige" che siano di appiglio per gli Operatori a mantenere lo status quo&lt;/span&gt; (assenza di concorrenza). Non sarebbe la prima volta che accade, in Italia. &lt;span style="font-weight: bold;"&gt;Ecco perchè insistiamo a chiedere, prima di procedere ad un eventuale riesame della normativa:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;&lt;ul&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt; &lt;span style="font-weight: bold;"&gt;sanzioni &lt;/span&gt;per i soggetti che hanno tenuto contegni illegittimi rispetto alla normativa ancora in essere&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;&lt;span style="font-weight: bold;"&gt;emissione di delibere dirette all'interruzione immediata di tali contegni&lt;/span&gt;.&lt;br /&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;p class="MsoNormal"&gt;&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;span style="font-weight: bold;"&gt;Commento agli orientamenti espressi nell'allegato B della delibera:&lt;/span&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;&lt;span style="font-weight: bold;font-size:100%;" &gt;&lt;/span&gt;&lt;p class="MsoNormal"&gt; &lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;   Nella delibera l'AGCOM evidenzia che i servizi offerti attraverso le numerazioni 4XXXX consistono principalmente in servizi a sovrapprezzo e in non servizi interni di rete come previsto dalla normativa vigente. &lt;/span&gt;&lt;/p&gt; &lt;span style="font-size:100%;"&gt;La proposta dell'AGCOM è quella di mantenere tali numerazioni brevi per i servizi a sovrapprezzo, considerando che rispetto a quelle già regolamentate (a 9 cifre), sono ricordabili più facilmente dai consumatori; &lt;/span&gt;&lt;span style="font-size:100%;"&gt;queste numerazioni verrebbero dedicate ufficialmente ai servizi a sovrapprezzo e diventerebbero PUBBLICHE, come tali &lt;b style=""&gt;interoperabili&lt;/b&gt; ed &lt;/span&gt;&lt;span style="font-weight: bold;font-size:100%;" &gt;assegnabili dal Ministero delle comunicazioni al pari di tutte le altre numerazioni a chiunque ne faccia richiesta&lt;/span&gt;.&lt;span style="font-size:100%;"&gt; Su tutto questo concordiamo pienamente.&lt;br /&gt;&lt;/span&gt;&lt;p class="MsoNormal"&gt; &lt;/p&gt;&lt;span style="font-size:100%;"&gt;L'interoperabilità garantisce la conocorrenza tra gli operatori, si suppone quindi che le retrocessioni&lt;sup&gt;(1)&lt;/sup&gt; corrisposte ai Content Service Provider aumentino, arrivando almeno a quelle dei servizi 166/899, ovvero non inferiori al 75% (attualmente invece vanno dal 30% al 60%).&lt;br /&gt;&lt;br /&gt;L'AGCOM inoltre sottolinea come il &lt;/span&gt; &lt;span style="font-weight: bold;font-size:100%;" &gt;costo di attivazione delle numerazioni brevi per i servizi a sovrapprezzo sarà analogo a quello di altre numerazioni&lt;/span&gt;&lt;span style="font-size:100%;"&gt; che presentano disponibilità similari.&lt;br /&gt;&lt;br /&gt;Questa modifica al piano di numerazione interromperebbe finalmente l’assegnazione arbitraria di queste numerazioni effettuata finora dagli operatori. &lt;/span&gt;  &lt;p class="MsoNormal"&gt;   &lt;span style="font-weight: bold;font-size:100%;" &gt;Finalmente ogni azienda potrà vendere servizi al prezzo che ritiene più concorrenziale, &lt;/span&gt;&lt;span style="font-size:100%;"&gt;nei limiti di prezzo fissati dall'Autorità. &lt;/span&gt;&lt;/p&gt; &lt;span style="font-size:100%;"&gt;&lt;/span&gt;&lt;p class="MsoNormal"&gt; &lt;/p&gt; &lt;span style="font-size:100%;"&gt;Nella parte finale della delibera, l'AGCOM prevede un &lt;/span&gt;&lt;span style="font-weight: bold;font-size:100%;" &gt;periodo transitorio di almeno sei mesi &lt;/span&gt;&lt;span style="font-size:100%;"&gt;per consentire alle aziende e alle Istituzioni di adeguarsi alle nuove disposizioni, ma sottolinea che in questo periodo potrebbe essere consentita la prosecuzione dei servizi solo &lt;/span&gt;&lt;span style="font-weight: bold;font-size:100%;" &gt;nel rispetto delle norme vigenti&lt;/span&gt;&lt;span style="font-size:100%;"&gt;. &lt;/span&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;   Considerato che: &lt;/span&gt;&lt;/p&gt;  &lt;ol&gt;   &lt;li&gt;     &lt;span style="font-size:100%;"&gt;&lt;span style=""&gt;&lt;span style=""&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt;la normativa vigente prevede l’utilizzo delle numerazioni 4XXXX solo per servizi &lt;span style="font-weight: bold;"&gt;interni &lt;/span&gt;di rete erogati dall'operatore stesso   &lt;/span&gt;&lt;/li&gt;   &lt;li&gt;&lt;span style="font-size:100%;"&gt;     gli operatori di telefonia, come evidenziato dalla stessa AGCOM nella delibera, &lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;"utilizzano tale numerazione per offrire un’ampia varietà di servizi che certamente non possono essere classificati tutti come “interni di rete”, ma che sono palesemente ascrivibili alla categoria dei servizi a sovrapprezzo"&lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt;   &lt;/li&gt; &lt;/ol&gt; &lt;span style="font-size:100%;"&gt;Riteniamo che:&lt;br /&gt;&lt;/span&gt;&lt;ul style="font-weight: bold;"&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;l'AGCOM dovrebbe ordinare la sospensione di tutti i servizi a sovrapprezzo attualmente forniti in decade 4,&lt;/span&gt;&lt;span style="font-size:100%;"&gt; fino all'entrata in vigore delle nuove norme.&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;span style="font-size:100%;"&gt;oppure:&lt;/span&gt;&lt;ul&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;&lt;span style="font-weight: bold;"&gt;l'AGCOM dovrebbe ordinare agli Operatori di attivare una numerazione ad ogni Content Service Provider che ne faccia richiesta, entro un tempo ridotto e comunque inferiore a 30 giorni, senza contributi di attivazione o minimi garantiti (condizioni a cui gli attuali Content Service Provider hanno lavorato in questi anni), stabilendo norme che facilitino l'equa redistribuzione delle quote di mercato attuali, ottenute in modo illegittimo dagli operatori del settore, come ad esempio la pubblicizzazione dei servizi aperti dai nuovi Content Service Provider a carico degli Operatori di rete.&lt;/span&gt;&lt;br /&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;span style="font-size:100%;"&gt;Lasciare la situazione attuale in attesa di scrivere le nuove norme, e quindi per un periodo che si suppone essere di molti mesi, più l'eventuale periodo transitorio, appare una &lt;span style="font-weight: bold;"&gt;palese violazione al principio generale della concorrenza, nonchè alle norme costituzionali contro la discriminazione di qualunque soggetto davanti alla legge&lt;/span&gt;.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-weight: bold;font-size:100%;" &gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt; &lt;span style="font-weight: bold;font-size:130%;" &gt;Segnala il tuo caso&lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt; &lt;p class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt; font-style: italic;"&gt;9. Rules for assigning and use of decade 4 numeration &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;At present, the use of decade 4 numeration sees the offer of a vast range of services, by the operators in control of a network, that certainly cannot be labeled as “network internal”, and some of those, on the contrary, are clearly classifiable as value added services.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;It is deemed that such situation requires serious consideration, by deliberating in the revision of the Plan all the dispositions necessary to fill previous law holes and &lt;span style="font-weight: bold;"&gt;efficiently countervail non correct uses of the numeration&lt;/span&gt;. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;&lt;br /&gt;On the other hand, it is also deemed that the rule that allows the use of decade 4 as a short code for value added services already offered on an another public numeration should be surpassed by the profound revision of decade 4 use here being proposed. &lt;span style="font-weight: bold;"&gt;Besides, as pointed out by some contributions, this possibility creates a situation of obvious advantage for those network carriers that also perform as content providers, in comparison to other service providers. &lt;/span&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;&lt;br /&gt;Given the motivations mentioned above, it’s proposed to restrict the numerations of, strictly speaking, internal network services to the sole numerations 4XU….U with X= 0, 1, 2, while keeping the obligation of preventive communication of activation to the Ministry and the Authority (not excluding the opportunity of requesting a contribute for restoring the administrative dues) and peremptorily forbidding their use for value added services. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;&lt;br /&gt;It is deemed that the meaning of internal network services might include, at best, those services that are “auxiliary” to the base service, thus completing its usage by the users, such as i.e. listening to the voicemail, urgent call alert, etc., bounding those applications to the 41 and 42 codes. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;&lt;br /&gt;Additionally, a price differentiation by the second number is proposed, as below: &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;40U…U calls that are free for the user &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;41U…U the maximum price is determined by the price of the calls for non value added services terminated on the same network calculated on the user’s price profile &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;42U…U 0,30 euro maximum answer quota and 1,00 euro maximum quota per minute, or 1,50 euro forfait. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;In the present offer of value added services, it’s noticeable that the decade sees an intense use for a category of value added services that are characterized by an activation via SMS sent to a decade 4 numeration and by the delivery of said service to the user via SMS/MMS, eventually on the basis of a periodic subscription plan. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;Therefore, it is proposed to allow the use, for those value added services, of a subset of decade 4 numerations (4X with X=3,4,6,7,8 and 9), while estimating a category distinction based on the second number, by a) social info services, c) mass call services, d) entertainment services, e) product selling and broadcasting services)..:&lt;br /&gt; &lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;&lt;span style="font-weight: bold;"&gt;These numerations would therefore become “public”, thus interoperable and assignable by the Ministry of Communications in the same way and by the procedures all other numerations are assigned, after payment of a contribution determined by analogy to contributions already charged for other numerations with similar availability. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;Taken into account that typically such use requires a five number code, the assignment could be restricted to a single number.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;In the same way as with other numerations used for value added services, it is proposed to set an expense limit. In particular, a &lt;span style="font-weight: bold;"&gt;2 euro limit for each “una tantum” received service&lt;/span&gt; with one or more SMS and &lt;span style="font-weight: bold;"&gt;20 euro monthly limit for subscription based services is proposed&lt;/span&gt;. A particular limit, &lt;span style="font-weight: bold;"&gt;0,25 euro&lt;/span&gt;, would be set for the numerations (starting with code 44) dedicated &lt;span style="font-weight: bold;"&gt;to mass call services&lt;/span&gt;, in line with the price caps already set for other numerations reserved for the same service.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;It’s important to note that the proposed modifications have significant impact on the present regulatory structure concerning the use of the decade, therefore it is deemed it would be convenient to adopt a transitory period of suitable duration, in order to allow actuation (by the Institutions) of all necessary initiatives for adjusting to the new directives and also to allow an effective information of the users.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;It is reckoned such period might be valuated in at least six months from the approval of the new plan, during which period the use of numerations in decade 4 might be allowed on present conditions &lt;span style="font-weight: bold;"&gt;with respect of applicable laws&lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;It is to be noted, finally, that in this proposal the new Plan reserves the code 456 to the general tariff transparency service, while determining the obligations of the mobile and fixed network operators, with respect of the rules that regulate number portability. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;[omissis] &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;In short: &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;In this deliberation the AGCOM states that the services being offered on 4XXXX numerations are mainly value added services and not internal network services, as ruled by present regulations.&lt;br /&gt;&lt;br /&gt;The AGCOM proposal is to maintain those short codes, more easily remembered by the final users than the regular (9 numbers).&lt;br /&gt;&lt;br /&gt;The AGCOM therefore proposes changes to the rules, to officially dedicate 43XXX, 44XXX, 46XXX, 47XXX, 48XXX, 49XXX numerations to value added services and making them PUBLIC, and as such &lt;span style="font-weight: bold;"&gt;interoperable &lt;/span&gt;and &lt;span style="font-weight: bold;"&gt;assignable by the Ministry of Communications in the same way all other numerations are assigned to anyone that makes request&lt;/span&gt;, and not by an arbitrary decision of the operator.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Interoperable means&lt;/span&gt; that, anyone wishing to offer a value added or premium service may activate a numeration with any of the operators, now all being in competition to one another. Such number would have to be usable on any network of any operator, and in the case of a SMS Premium number it would be capable of receiving/sending SMS and billing. The premium services interoperability is nothing new, since it’s already effective for 166/899 numerations.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;The interoperability guarantees competition&lt;/span&gt; between operators, therefore it may be assumed that the revenues(1) credited by the operators to the Content Service Providers will become more similar to those of 166/899 services, never below 75%.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;The AGCOM also states that the activation cost of the short codes for value added services will be the same as the cost of other numerations with similar availability.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;This change to the numeration plan would finally stop the present arbitrary assignation of these numerations by the operators.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Finally, any company could sell value added services at the price it believes more adequate, within the price limits set by the regulator. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;The PULL services price cap is very interesting, a limit that favors the growth of the market similar to those countries where the per capita usage of these services is much higher than in Italy. This means the price of tunes, wallpapers, games or any other content may never exceed the cap set by the regulator.&lt;br /&gt;&lt;br /&gt;In the last part of its deliberation, the AGCOM foresees a &lt;span style="font-weight: bold;"&gt;transitory period of at least six months&lt;/span&gt; in order to allow companies and Institutions to adjust to the new rules, but clearly states that during such period the use of the decade 4 numerations &lt;span style="font-weight: bold;"&gt;may be permitted with respect of applicable laws&lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;Considering that:&lt;br /&gt;&lt;br /&gt;1. the present regulations determine the use of 4XXXX numerations only for internal network services provided by the operator himself&lt;br /&gt;2. the telephony operators, as stated by the AGCOM in its document, "use these numerations to offer a vast range of services that certainly cannot be all labeled as “network internal”, but on the contrary, are clearly classifiable in the category of value added services"&lt;br /&gt;&lt;br /&gt;all such services should be temporarily suspended until the new rules pass. Alcuni dati osservati &lt;span style="font-weight: bold;"&gt;nel Regno Unito&lt;/span&gt; (uno dei mercati più regolamentati d'Europa), evidenziano come &lt;span style="font-weight: bold;"&gt;oltre il 74% dei consumatori sia insoddisfatto dei servizi a sovrapprezzo &lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;Qual è la percentuale dei consumatori non soddisfatti &lt;span style="font-weight: bold;"&gt;in Italia?&lt;/span&gt; L'osservatorio del Politecnico purtroppo non ha analizzato questo importante dato, che Andrew Bus sostiene essere essenziale per un corretto e duraturo sviluppo del mercato&lt;br /&gt;&lt;br /&gt;Cuore della sessione pomeridiana del convegno è stato un autorevole dibattito cui hanno partecipato i Vertici degli Operatori di telefonia mobile italiani e di rilevanti Web company e Software &amp; Technology provider moderati dal &lt;span style="font-weight: bold;"&gt;Prof. Umberto Bertelè&lt;/span&gt; (Presidente School of Management del Politecnico di Milano). Questo mercato è già stato liberalizzato più di 15 anni fa ok? Non c'è da liberalizzare un bel niente.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;Il problema è che forse questo mercato dei servizi a sovrapprezzo è strutturato volutamente strutturato in modo da tutelare illegalmente gli interessi di pochi. Per i servizi a sovrapprezzo in decade 48XXX ognuno dei quattro operatori è di fatto monopolista sui propri clienti. Sono 4 monopoli. Per esempio, non è possibile offrire servizi a sovrapprezzo via SMS se non facendo singolarmente accordi con ognuno dei quattro operatori, rischiando tra l'altro che uno o più di questi neghino l'apertura del servizio per ragioni arbitrarie.&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;Prima che qualcuno mi impedisca di continuare vi informo che il testo completo di questo intervento è pubblicato sul sito &lt;span style="color: rgb(0, 0, 0);"&gt;WWW.SMSVAS.COM&lt;/span&gt; dove c'è anche ulteriore materiale di approfondimento, ripeto WWW.SMSVAS.COM. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;Qualcuno dei presenti ha provato a realizzare in questi anni in Italia un servizio SMS Premium, ma per caso non è riuscito a farlo perché gliel’hanno impedito? Vi prego di alzare la mano.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;A noi è capitato! Gli operatori sostengono che è un servizio interno e quindi l’attivazione è effettuata esclusivamente a loro insindacabile giudizio. Ma chi gliel'ha dato questo diritto di decidere? Solo se c'è una legge questo diritto è legale. Altrimenti è un monopolio illegale.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;Magari di leggi ce ne sono e io non ne conosco, mi scuso in anticipo per la mia ignoranza.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;&lt;span style="font-family:georgia;"&gt;&lt;br /&gt;&lt;br /&gt;Io però una legge l'ho trovata, la &lt;a href="http://www.agcom.it/provv/d_09_03_CIR.htm#10"&gt;delibera AGCOM n. 9 del 2003&lt;/a&gt;, è una delibera di una authority con valore di legge, è pubblicata sulla Gazzetta Ufficiale (il 1° agosto 2003).&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;Si intitola “Piano di numerazione nel settore delle telecomunicazioni e disciplina attuativa”, &lt;b&gt;Articolo 10,&lt;/b&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;COMMA 1&lt;/span&gt;: questo articolo si riferisce alle numerazioni in decade 4, quindi riguarda pienamente le numerazioni 48 con cui si fanno i servizi a sovrapprezzo oggetto di questo osservatorio. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; font-style: italic;"&gt;COMMA 2&lt;/span&gt;&lt;span style="font-style: italic;"&gt; lo leggo testualmente, è brevissimo e ogni parola è un macigno: "Queste numerazioni sono &lt;/span&gt;&lt;b style="font-style: italic;"&gt;dedicate&lt;/b&gt;&lt;span style="font-style: italic;"&gt; ai &lt;/span&gt;&lt;b style="font-style: italic;"&gt;servizi forniti dall’operatore stesso,&lt;/b&gt;&lt;span style="font-style: italic;"&gt; &lt;/span&gt;&lt;b style="font-style: italic;"&gt;correlati con le funzionalità di rete&lt;/b&gt;&lt;span style="font-style: italic;"&gt; e che &lt;/span&gt;&lt;b style="font-style: italic;"&gt;non necessitano di interoperabilità tra reti di operatori diversi&lt;/b&gt;&lt;span style="font-style: italic;"&gt;. L’offerta [omissis] è subordinata al rispetto del &lt;/span&gt;&lt;b style="font-style: italic;"&gt;blocco selettivo di chiamata &lt;/b&gt;&lt;span style="font-style: italic;"&gt;(che invece non si può attivare in nessun modo) &lt;/span&gt;&lt;b style="font-style: italic;"&gt;e sui servizi a sovrapprezzo&lt;/b&gt;&lt;span style="font-style: italic;"&gt;." chiuse virgolette.&lt;/span&gt;&lt;br /&gt;&lt;p class="MsoNormal"  style="margin-left: 3.4pt; text-align: left; text-indent: 35.45pt; font-style: italic;font-family:georgia;" align="left"&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;o:p&gt;&lt;/o:p&gt;Cosa vuol dire servizi forniti dall’operatore correlati con le funzionalità di rete? Questi servizi sono la segreteria telefonica, avviso di chiamata, chi è, credito residuo, la trasparenza tariffaria (comma 8). Vi ricordate? Nel 2003 tutti questi servizi sono stati rinominati col numero 4 davanti.&lt;o:p&gt;&lt;/o:p&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;I servizi VAS oggetto di questo osservatorio, per i quali i consumatori hanno speso nel 2006 &lt;span style="font-weight: bold;"&gt;1 miliardo e mezzo di euro&lt;/span&gt;, 5 volte il mercato discografico italiano, anche questi iniziano per 4, e quindi devono sottostare a quelle condizioni della delibera. Vediamo.&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;Devono essere forniti dagli “operatori stessi”. E' vero o sono forniti quasi tutti da terze parti? Chi sono quei signori che hanno parlato nel dibattito precedente? Sono dipendenti degli operatori mobili o di altre società chiamate Mobile Media Companies? Quelle società (Buongiorno, Dada, David2, ecc) pubblicizzano autonomamente i servizi con i loro brand e lo fanno in modo trasversale e indipendente dall'operatore (ovvero uno stesso servizio è accessibile dai quattro operatori). Allora non capisco come si possa dire che questi servizi siano "forniti dagli operatori stessi". &lt;a href="http://www.blogger.com/post-edit.g?blogID=3460490175855161535&amp;postID=2621403455165925593#_ednref1" title=""&gt;&lt;span style="color:blue;"&gt;[i]&lt;/span&gt;&lt;/a&gt; &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;Ma anche se riusciste a spiegarlo in modo convincente, andiamo avanti con la delibera. Scusate ma non credo di essere fuori tema e non mi sembra neanche una questione marginale. Leggo: “correlati con le funzionalità di rete”. L'oroscopo via SMS è collegato con le funzionalità di rete? Ariete, la vostra copertura sarà ottimale per tutta la giornata.&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;I loghi, le suonerie sono collegati con le funzionalità di rete? E' legale fornire questi servizi in decade 4? &lt;b&gt;QUELLA DELIBERA DICE CHIARAMENTE DI NO!&lt;/b&gt; Ma da alcuni anni lo fate lo stesso. BRAVI! &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;Ma il comma 2 non è ancora finito: “e che non necessitano &lt;b&gt;di interoperabilità &lt;/b&gt;&lt;a href="http://www.blogger.com/post-edit.g?blogID=3460490175855161535&amp;postID=2621403455165925593#_ednref2" title=""&gt;&lt;span style="color:blue;"&gt;[ii]&lt;/span&gt;&lt;/a&gt;&lt;b&gt; tra reti di operatori diversi”.&lt;/b&gt; &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;&lt;br /&gt;&lt;br /&gt;Perchè per questi, che sono a tutti gli effetti servizi a sovrapprezzo, non sarebbe necessaria l’interoperabilità&lt;a name="_ednref2"&gt;&lt;/a&gt;, visto che è necessaria per tutti gli altri servizi a sovrapprezzo 166, 899 ecc?&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt; &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;br /&gt;&lt;br /&gt;Come avviene nei servizi regolamentati, 899, 166, ecc grazie all'interoperabilità qualsiasi azienda può facilemente attivare ed offrire un servizio a sovrapprezzo a qualsiasi consumatore indipendentemente dall'operatore al quale questo appartiene.&lt;br /&gt;&lt;br /&gt;Il numero di aziende che oggi in Italia possono vendere servizi a sovrapprezzo è limitato (qualche decina) e potenzialmente molto alto. Ciò perché gli operatori non consentono a tutte le aziende interessate di attivare servizi a sovrapprezzo in base alle norme della libera concorrenza, mascherandosi dietro la decade 48XXX il cui utilizzo è consentito dalla legge solo per i servizi interni di rete dove chiaramente non esiste regolamentazione.&lt;br /&gt;&lt;br /&gt;Grazie all'interoperabilità vige la concorrenza tra gli operatori ed ogni azienda che vuole offrire il servizio seleziona il proprio fornitore in base alle migliori condizioni proposte.&lt;br /&gt;&lt;br /&gt;Da alcuni anni gli operatori mobili non rispettano la legge, controllando e limitando la crescita del mercato a favore di poche aziende e danneggiando i consumatori che sono costretti a pagare prezzi molto alti&lt;br /&gt;&lt;br /&gt;I consumatori italiani e le potenziali aziende interessate ad offrire questi servizi vengono danneggiate perché non viene applicata una legge, che esiste già e che regolamenta le numerazioni per erogare servizi a sovrapprezzo (166, 899, ecc).&lt;br /&gt;&lt;br /&gt;E' venuto qualcuno dell'authority? Noi abbiamo già fatto due esposti, non abbiamo neanche avuto risposta! Ecco il livello di comunicazione dell'authority della comunicazione.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;Diciamola apertamente la situazione qual è, se non avete il coraggio di dirla voi dell'osservatorio la dico io.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;ul style="font-style: italic;"&gt;&lt;li&gt;E’ lecito che gli operatori si spartiscano, metà loro, metà gli 8 service provider esistenti (non consideriamo i piccoli), questa torta da 1 miliardo e mezzo di euro, pari a 5 volte l'intero mercato discografico italiano?&lt;/li&gt;&lt;/ul&gt;&lt;ul style="font-style: italic;"&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;Sono lecite le barriere all’ingresso esistenti, ad esempio che TIM chieda 50mila euro di attivazione per un numero premium? Perché un numero premium  899/166 costa solo 20 euro?&lt;br /&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;ul style="font-style: italic;"&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;E' lecito che gli 8 service provider esistenti siano stati esentati dal pagamento di questi 50mila euro?&lt;br /&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;ul style="font-style: italic;"&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;E’ lecito che Vodafone chieda 50mila euro al &lt;b&gt;mese &lt;/b&gt;di traffico garantito? &lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;ul style="font-style: italic;"&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;E’ lecito che gli operatori possano decidere arbitrariamente di non attivare un servizio ad un'azienda perché non soddisfa i loro requisiti di redditività minima, anche se era per pubblica utilità e/o per minoranze?&lt;br /&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;ul style="font-style: italic;"&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;E’ lecito che un operatore abbia il potere di chiudere arbitrariamente una numerazione o un servizio già in essere senza nemmeno fornire alcun motivo? &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;ul style="font-style: italic;"&gt;&lt;li&gt;&lt;span style="font-size:100%;"&gt;E’ lecito che le percentuali trattenute dagli operatori sul prezzo di vendita al consumatore siano superiori al 50 o 60%? Guardate che io non ce l’ho tanto con gli 8 content service provider che oggi distribuiscono servizi a sovrapprezzo in Italia, perché con queste retrocessioni così ridotte, considerando anche il costo pubblicitario, la SIAE ecc. per avere redditività bisogna fare delle cose orrende come i servizi ad abbonamento occulti. Infatti l'unica che non lo fa, perchè va dato atto, è Mediaset. Vero è anche che ha costi inferiori per la pubblicità. Però avrebbe avuto più margine e ha scelto la trasparenza. Ma anche se per gli altri è necessario ai fini del profitto non significa che diventi automaticamente &lt;b&gt;legale&lt;/b&gt; e tantomeno &lt;b&gt;giusto&lt;/b&gt; o da applaudire! Ve li meritate i nostri applausi? Per gli operatori questi servizi rappresentano dal 15% al 30% del fatturato, senza considerare il traffico indotto, ovvero il costo del traffico per effettuare la richiesta o per scaricare il contenuto. L'operatore sostiene che tale ritenuta è necessaria per coprire i costi di trasporto dell'SMS (ma sappiamo benissimo che il costo industriale di di un SMS è di qualche millesimo e non qualche euro) e il costo di fatturazione. Ad esempio sul prezzo pagato da un consumatore di 3 euro iva esclusa, l'operatore trattiene fino a 2 euro.&lt;br /&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;Tutte queste distorsioni del mercato discendono dall’assenza dell’interoperabilità. La cosa incredibile è che la legge c'è già, l'authority o il ministro che non è venuto basterebbe che dessero un termine perentorio entro cui attivare l'interoperabilità per questi servizi.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt; &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;&lt;br /&gt;&lt;br /&gt;Questo è quello che chiedo: attivate l'interoperabilità subito.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;&lt;br /&gt;&lt;br /&gt;E non ve lo chiedo solo io, timidamente ve l'ha già chiesto più di una persona oggi, e moltissima gente in tutti questi anni. &lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;&lt;br /&gt;&lt;br /&gt;C'è qualcuno in questa sala che è contrario all'interoperabilità?&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;&lt;br /&gt;&lt;br /&gt;Abbiamo l'unanimità.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;&lt;br /&gt;&lt;br /&gt;Lo chiedo a voi operatori. Mostrate un po' di dignità. Imparate un po' dal passato dai.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt;&lt;b&gt;&lt;span style=""&gt;&lt;br /&gt;&lt;br /&gt;Noi comunque ci siamo stancati di subire in silenzio e da adesso ci faremo sentire, ci stiamo riunendo&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;span style="font-style: italic;font-size:100%;" &gt; in associazione di categoria. Nella filiera ci sono anche loro? Sono  contenti i  consumatori di questi servizi? L'unica informazione che ci è stata data in tutta la  giornata è quella di Andrew Bud ed è riferita al mercato inglese. Forse non ci sono perchè  i risultati italiani sono ancora più vergognosi del 74% di insoddisfazione  degli inglesi? C’è qualcuno qua dentro soddisfatto di aver comprato un servizio  premium? Alzate pure le mani! Ecco fatto il sondaggio. Quanti di voi si sono  trovati iscritti &lt;strong goog_ds_charindex="7466"&gt;senza saperlo&lt;/strong&gt; a  qualche servizio e poi sono riusciti a cancellarsi con immediatezza e facilità?  Il prossimo anno fate un sondaggio indipendente e mettetelo sul report. Ma  secondo voi lo sanno e gli va bene? Sono tutti così ricchi e così generosi? Ecco perché vincere è meraviglioso. Inoltre i content service provider si occupano di tutta la filiera,  dall’ideazione del servizio, alla pubblicizzazione a proprie spese. Il media  plan è uno dei principali requisiti che l’operatore pretende di vagliare per  prendere&lt;/span&gt;&lt;/span&gt;&lt;span goog_ds_charindex="11083"  style="font-size:100%;"&gt;&lt;span&gt; in  considerazione l’attivazione di un &lt;u goog_ds_charindex="11123"&gt;servizio&lt;/u&gt;  proposto da un&lt;/span&gt;&lt;/span&gt;&lt;span goog_ds_charindex="11149"  style="font-size:100%;"&gt;&lt;span&gt;  &lt;/span&gt;&lt;/span&gt;&lt;span goog_ds_charindex="11152"  style="font-size:100%;"&gt;&lt;span&gt;service provider. L'interoperabilità permette la raggiungibilità di questo  servizio dagli utenti di tutti gli operatori fissi e mobili. L'interoperabilità  è obbligatoria per i servizi a sovrapprezzo,in quanto è esclusa nella normativa  solo per i servizi in decade 4, che sono riservati solo ai servizi interni  correlati con le funzionalità di rete.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span goog_ds_charindex="12168"  style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;&lt;span goog_ds_charindex="12168"  style="font-size:100%;"&gt;&lt;span goog_ds_charindex="12169"&gt;&lt;span&gt;Negli ultimi anni i  servizi SMS Premium, che sono servizi a sovrapprezzo a tutti gli effetti e sono  raggiungibili anche telefonicamente con chiamata vocale, sono stati realizzati  abusivamente in decade 4.&lt;br /&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/div&gt;   &lt;span goog_ds_charindex="12381"  style="font-size:100%;"&gt;&lt;span goog_ds_charindex="12382"&gt;&lt;span&gt;&lt;br /&gt;In questa particolare  numerazione, essendo esclusa l'interoperabilità, un service provider interessato  ad attivare un servizio non può più scegliere l'operatore che applica le  migliori condizioni, ma è obbligata a rivolgersi a tutti gli operatori, cioè ai  4 operatori mobili e a Telecom Italia con cui raggiunge il 100% di copertura del  mercato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span&gt; &lt;/span&gt;&lt;br /&gt;&lt;span goog_ds_charindex="12733"  style="font-size:100%;"&gt;&lt;span goog_ds_charindex="12734"&gt;&lt;span&gt;&lt;br /&gt;Questi operatori,  dacchè ciascuno è monopolista per quanto riguarda la sua fetta di mercato,  applicano condizioni capestro come:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span&gt; &lt;/span&gt; &lt;ul goog_ds_charindex="12867"  style="font-family:georgia;"&gt;&lt;span&gt;&lt;li goog_ds_charindex="12868"&gt;&lt;span goog_ds_charindex="12869"  style="font-size:100%;"&gt;&lt;span goog_ds_charindex="12870"&gt;percentuali di  retrocessione inferiori al 45% (per ogni euro pagato dal cliente finale, solo  0,45 euro arrivano al fornitore di servizio, che deve pagare il costo  pubblicitario, eventuali diritti SIAE e il costo del contenuto, pertanto il  valore effettivo del contenuto è minimo rispetto a quanto corrisposto dal  cliente finale)&lt;br /&gt;&lt;/span&gt;&lt;/span&gt; &lt;/li&gt;&lt;li goog_ds_charindex="13203"&gt;&lt;span goog_ds_charindex="13204"  style="font-size:100%;"&gt;&lt;span goog_ds_charindex="13205"&gt;ingenti commissioni di  attivazione (50.000 euro per TIM) o minimi garantiti mensili per  Vodafone&lt;/span&gt;&lt;/span&gt;  &lt;/li&gt;&lt;li goog_ds_charindex="13320"&gt;&lt;span goog_ds_charindex="13321"  style="font-size:100%;"&gt;&lt;span goog_ds_charindex="13322"&gt;diritto di veto sui  servizi attivabili&lt;/span&gt;&lt;/span&gt;  &lt;/li&gt;&lt;li goog_ds_charindex="13365"&gt;&lt;span goog_ds_charindex="13366"  style="font-size:100%;"&gt;&lt;span goog_ds_charindex="13367"&gt;diritto di  assegnazione del prezzo ad ogni servizio attivato, impedendo di fatto ogni tipo  di concorrenza fra fornitori di servizi diversi (es: il prezzo imposto per le  suonerie è di 3 euro, non è possibile per nessun fornitore di contenuti vendere  tali servizi a un prezzo diverso)&lt;/span&gt;&lt;/span&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Mr. Preda asks if the monopoly of the VAS based on the short code 48XXX, the ones for which Italian consumers spend every year 1,5 billion euro, is legal, considering that it seems there aren’t any laws supporting this monopoly, while there is a deliberation, the # 9 made by AGCOM, the Italian telecommunication authority &lt;span style=""&gt; &lt;/span&gt;but there is a question that I feel as the most important of all and that today has been addressed only in a very shy manner. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;Is this market legal?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;This morning, during the introduction, the Telcos were advised by the organizers to LIBERALIZE this market in order to encourage the competition and hence the growth. The liberalization of this market has been done 15 years ago, ok? There is nothing to liberalize.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Maybe the problem is that this VAS market has been voluntary structured in a way that favors illegally the interests of a few. For the VAS distributed with the short code 48XXX each and every one of the four operators is a de facto monopolist in his own share of the market. There are 4 monopolies. For example, it’s not possible to offer SMS VAS, if you don’t sign a single agreement with each of the four mobile operators, exposing to the risk that one or more of them deny the activation for arbitrary reasons.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Before someone interrupts me I want to inform you that this entire speech is available at &lt;a href="http://www.smsvas.com/"&gt;WWW.SMSVAS.COM&lt;/a&gt; where you may also find more interesting material, I repeat smsvas.com.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Is there someone among the present here now that has tried to launch an SMS Premium service but couldn’t because they wouldn’t let you do it? I ask you to raise a hand.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;(It happened to us), they tell you/us that the service is an internal service and therefore the activation is their unchallengeable decision. But who gave them the right to decide? This is legal only if there is a law to say so. Otherwise, it’s illegal monopoly.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Maybe there are laws that I don’t know of, I apologize in advance for my ignorance.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;But there is one law I found, it’s the deliberation n.9 by AGCOM in 2003, this is a legally bounding resolution of an Authority, published in the Gazzetta Ufficiale (August, 1&lt;sup&gt;st&lt;/sup&gt; 2003).&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;It is entitled “Numeration plan in the telecommunications sector and implementation discipline”, and states in &lt;b style=""&gt;Art. 10&lt;/b&gt;:&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;COMMA 1: this article concerns decade 4 numerations, which means it is fully pertinent to the numerations 48 used to deliver the premium services object of this observatory.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;COMMA 2, I’ll read it literally, it’s very short and each word weights a ton: “This numerations are &lt;b style=""&gt;dedicated &lt;/b&gt;to&lt;b style=""&gt; services *provided by the *same *operator, *correlated with *network *functionality &lt;/b&gt;and that&lt;b style=""&gt; *don’t *require *interoperability with other operators’ networks. &lt;/b&gt;The offer blabla is subordinated to the respect of the &lt;b style=""&gt;selective call blocking&lt;/b&gt; (but there is no way you can activate it) &lt;b style=""&gt;and value added services blocking&lt;/b&gt;”. End quote.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;What does it mean - services provided by the operator correlated with network functionality? It’s the voicemail, call waiting, call ID, the credit left on your prepaid, etc… You remember those? All those services were changed to decade 4 in 2003.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;These VAS services object of this observatory, that generate 1,5 billion euro of income, 5 times the Italian music industry, these services numerations also start with a 4, therefore they need to respect all the above conditions. Let’s see.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;They are to be provided by the “operators themselves”. But isn’t it true that almost all of these services are supplied by third parties? Who are those gentlemen we heard speaking in the previous session? Are they MNOs’ employees or do they work for other companies, called Mobile Media Companies? These companies advertise freely their services using their own brand, and they are doing it transversally and operator independent. How can we say that these services are “provided by the operators themselves”, I don’t understand. [i]&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Then again you might give me a convincing explanation, but let’s continue with our resolution. I’m sorry to annoy you all, but I don’t think I’m off topic and I don’t believe this is a marginal matter. I read: “correlated with network functionality”. The horoscope is connected with network functionality? Aries, you’ll have optimal coverage during the day.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;The logos, the tunes, are these connected with network functionality? Is it legal to offer those services on decade 4 numerations? &lt;b style=""&gt;THIS DELIBERATION SAYS CLEARLY NO!&lt;/b&gt; But you kept doing it all the same for the last years. BRAVO!&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;But there’s more to the comma 2: “and that don’t require &lt;b style=""&gt;interoperability with other operators’ networks&lt;/b&gt;”. [ii]&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;These services are value added services, how can it be they don’t require interoperability when we know interoperability is required for other value added services, such as those on numerations 166, 899, etc?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;In the regulated services (899, 166, etc), thanks to the interoperability any company can easily activate and offer a VAS service to any consumer independently of the operator.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;The number of companies that today in Italy can sell VAS is limited (around ten) and potentially very high. This happens because mobile operators in Italy don’t allow to all interested companies to activate VAS services based on the laws of the free competition, masquerading behind the short number 48XXX, that is regulated by the law and can be used only for operator internal network services, that of course are not regulated.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Thanks to interoperability, it is in force the competition among operators, and each company that wants to offer a service selects its supplier basing its decision on the best conditions it can have.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;In the last years mobile operators in Italy don’t respect the law, controlling and limiting the market growth favoring few companies and damaging consumers that have to pay high prices for this kind of services.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Is there someone from the Telecommunication Authority here? We have exposed this problem to the AGCOM two times already, and never received an answer. So much for the Authority of Communications.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;Let’s speak plainly about this situation, if you in the observatory don’t have the courage to say it loud, I will.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt; text-indent: -18pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;-&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;Is it legal that the operators share, half to them and the other half to the 8 existing service providers (we don’t count the very little ones), this pie of 1,5 billion euro, worth 5 times the Italian discography market?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt; text-indent: -18pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;-&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;Are the entry barriers legal, such as TIM asking for 50.000 euro activation quota for a premium number? Why other regulated premium numbers like 899/166 cost only 20 euro each.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt; text-indent: -18pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;-&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;Is it legal that those existing 8 service providers were exonerated from the payment of these 50.000?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt; text-indent: -18pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;-&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;Is it legal that Vodafone demands a guaranteed minimum of 50.000 euro of monthly traffic?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt; text-indent: -18pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;-&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;Is it legal that the operators can arbitrarily decide not to activate a service because it doesn’t meet their minimum profitability requirement even if it’s a public utility service and/or for minorities?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt; text-indent: -18pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;-&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;Is it legal that an operator can decide to arbitrarily close an active numeration, without giving any explanation?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36pt; text-indent: -18pt;"&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;-&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;Is it legal that the percentage of revenue kept by the operator from end user price is above 50 or 60%? I’m not that angry on those 8 service providers that today are distributing VAS services in Italy, because if we consider these low revenues, the advertising costs, the ringtones licences fee, etc. to generate profit you need to come out with those horrible services such as those fake subscriptions. The only one that doesn’t do fake subscription services, we need to respect that, is Mediaset. But it’s also a fact that they have less advertising expenses. Mediaset could have a better margin but chose transparency instead. If others have to behave differently it doesn’t automatically mean it’s also &lt;b style=""&gt;legal&lt;/b&gt; or it’s &lt;b style=""&gt;correct&lt;/b&gt; and worth an applause. Do you deserve our applause?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;All this market distortions are caused by lack of interoperability. What’s unbelievable is that a law already exists, the Minister or the Authority could simply impose a deadline for interoperability of those services.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;This is what I ask: interoperability now!&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;And this is not only me asking, quite shyly more than one person asked the same today, and a whole bunch of people in the past years.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;Is there someone in this room that is against interoperability?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;We are unanimous.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;I ask the operators,. Show some dignity. Adapt to the laws and to the common sense, even if it is too late.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;b style=""&gt;&lt;span style="" lang="EN-US"&gt;Don’t wait until they force you to, there are always more problems if a Parliament has to decide, look for example at the Bersani Act that is bad in many points and the question of European roaming. Maybe there isn’t any because the Italian results are even      more disappointing than the 74% of the non satisfied English? Is there      someone in here that felt satisfied when buying a premium service? Please,      raise your hands! There’s your poll. How many of you got subscribed to a      service &lt;b style=""&gt;without knowing&lt;/b&gt; and      then easily and immediately managed to cancel your subscription? Next year      do an independent poll and insert it in your report. Maybe it’s because you      might discover that 80 out of 100 subscribers never download any content      but are still charged their weekly fee? You think they know it and are      good with it? Are they all so rich and generous? Or is this a *&lt;b style=""&gt;blatant&lt;/b&gt; proof that the conditions      are not so transparent?&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/li&gt;&lt;li class="MsoNormal" style=""&gt;&lt;span style="" lang="EN-US"&gt;This observatory whishes to be      impartial? One could take this for granted, but then again why haven’t you      written any of this in your report and you even censored a part of our box      telling us, I quote from your email, that “&lt;i style=""&gt;your organization cannot publish the following sentence:&lt;/i&gt; “In      Mobile Content area, since 2004 SMS Italia is ready to launch various      utility services with innovative business models with respect to those      currently adopted in the Italian market, but its entrance in this market      has been until now halted by entry barriers imposed by the first two      Italian MNOs, barriers that – as stated by the Company – do not exist in      any other European market”. That’s why winning is great”. There’s no need to say (or maybe we do need to say it here?) that, I quote, “&lt;b style=""&gt;you have to win the right way&lt;/b&gt;”, that is &lt;b style=""&gt;by playing it &lt;/b&gt;“&lt;b style=""&gt;cleanly and *by the rules&lt;/b&gt;”&lt;b style=""&gt;. It goes without saying. How can you say that this services are provided by the operator himself? Additionally the content service providers have to deal with the whole chain, from the initial idea to the advertising they have to pay for. The media plan is one of the main requirements that an operator takes into consideration when deciding whether to activate a &lt;u&gt;service&lt;/u&gt; proposed by the service provider, or not. If they were buying only a &lt;u&gt;content&lt;/u&gt; there would be no media plan to discuss of. If I want to buy some candies to fill my automatic candy machines I don’t care of the media and advertising budget of my supplier, but if I’m more interested in the media capacity then in the product itself, it’s not a content I’m providing any more, it’s a service!&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;[ii] INTEROPERABILITY: If a company (service provider) wants to sell a value added phone service to the general public or to a limited users community, the company can choose, as in any other service, the operator that offers better conditions. The interoperability allows us to reach any fixed or mobile user of any operator. The interoperability is mandatory for value added services, and is not requested only for decade 4 services, reserved for internal services related to network functionality.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;In the last years the Premium SMS services, that are clearly value added services and that are also available via voice call, have been abusively implemented on decade 4.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;With this particular numeration, being excluded from interoperability obligations, a service provider who wants to activate a service cannot choose an operator that offers better conditions, but needs to strike a deal with all operators, that is with the 4 MNOs and Telecom Italia in order to reach 100% coverage.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;These operators, each and every one of them a monopolist in their own market realm, are free to impose strangling conditions, such as:&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;ul&gt;&lt;li&gt;&lt;span style="" lang="EN-US"&gt;revenue shares below 45% (for each euro the client pays, only 0,45 euro are given to the service provider who also has to pay for advertising, copyright fees, and content production costs, therefore the content’s real value is obviously much lower than the sum paid by the final user)&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;high activation commissions (50.000 euro for TIM) or monthly minimum (50.000 euro for Vodafone)&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;right of veto on services that may or may not be activated&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;span style="" lang="EN-US"&gt;&lt;span style=""&gt;&lt;span style=""&gt;          &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="" lang="EN-US"&gt;right to determine the price for each service, thus making impossible any competition between service providers (i.e. a single tune is sold for 3 euro, and no provider is allowed to sell it with a different price)&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;        &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="" lang="EN-US"&gt;All of this is clearly at the expense of the users.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;&lt;div class="blogger-post-footer"&gt;&lt;img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/3460490175855161535-3560723321015024976?l=www.smsvas.com' alt='' /&gt;&lt;/div&gt;</content><link rel='replies' type='application/atom+xml' href='http://www.smsvas.com/feeds/3560723321015024976/comments/default' title='Commenti sul post'/><link rel='replies' type='text/html' href='http://www.blogger.com/comment.g?blogID=3460490175855161535&amp;postID=3560723321015024976' title='0 Commenti'/><link rel='edit' type='application/atom+xml' href='http://www.blogger.com/feeds/3460490175855161535/posts/default/3560723321015024976'/><link rel='self' type='application/atom+xml' href='http://www.blogger.com/feeds/3460490175855161535/posts/default/3560723321015024976'/><link rel='alternate' type='text/html' href='http://www.smsvas.com/2007/06/first-official-questioncomplaint-made.html' title='First official question/complaint made during the congress, organized by the Mobile Content Observatory of the Politecnico of Milan'/><author><name>Blogger</name><email>noreply@blogger.com</email><gd:image rel='http://schemas.google.com/g/2005#thumbnail' width='16' height='16' src='http://img2.blogblog.com/img/b16-rounded.gif'/></author><thr:total>0</thr:total></entry></feed>
